1. Agreement to Terms

By accessing or using GeniusTube (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

2. Description of Service

GeniusTube is an AI-powered analytics and optimization tool for YouTube creators. The Service provides:

  • AI analysis of YouTube video titles, thumbnails, descriptions, and transcripts
  • Packaging, content, and metrics analysis with scoring
  • Actionable recommendations for improving video performance
  • Pre-publish analysis for draft videos
  • Channel-wide analytics and insights

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Eligibility

To use the Service, you must:

  • Be at least 13 years old (or 16 in the European Economic Area)
  • Have a valid Google/YouTube account
  • Have the legal capacity to enter into this agreement

By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts

To use the Service, you must authenticate via Google OAuth. You are responsible for:

  • Maintaining the security of your Google account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from unauthorized use of your account.

5. User Content

The Service allows you to upload and analyze content including video files, titles, descriptions, thumbnails, and scripts ("User Content").

You retain ownership of your User Content. By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, and analyze your content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any laws or third-party rights
  • Your User Content does not contain malicious code or viruses

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that infringes on intellectual property rights
  • Upload content that is defamatory, obscene, threatening, or abusive
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service to transmit malware, viruses, or malicious code
  • Reverse engineer, decompile, or disassemble the Service
  • Resell, rent, or sublicense access to the Service
  • Use automated systems to access the Service without permission
  • Interfere with or disrupt the Service's functionality

7. Intellectual Property

The Service and its original content, features, and functionality are owned by GeniusTube and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Payment and Refunds

Fees: Certain features of the Service require payment. Fees are billed in advance on a monthly or annual basis.

Payment Method: Payments are processed through Stripe. You must provide accurate and complete billing information.

Refunds: We offer a 30-day money-back guarantee. If you are not satisfied with the Service within 30 days of purchase, contact us for a full refund.

Free Trial: New accounts receive 10 free tokens (2 video analyses) with no credit card required. Free trial tokens expire 30 days after account creation.

Price Changes: We reserve the right to modify pricing at any time. Changes will be effective at the next billing cycle.

Cancellation: You may cancel your subscription at any time. Your subscription will remain active until the end of the current billing period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service will meet your requirements
  • Analysis results will be accurate, complete, or reliable
  • Following recommendations will guarantee improved video performance

THE AI-POWERED ANALYSIS PROVIDED BY THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE GUARANTEES OF YOUTUBE PERFORMANCE OR ALGORITHM BEHAVIOR.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENIUSTUBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GENIUSTUBE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANYTHING.

11. Indemnification

You agree to indemnify, defend, and hold harmless GeniusTube and its officers, directors, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Suspected fraud or illegal activity
  • Conduct harmful to other users or the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where GeniusTube is established, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where GeniusTube is established.

14. Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes through good-faith negotiations with us. Contact us at contact@geniustube.io and describe the dispute and your proposed resolution.

If we cannot resolve the dispute within 60 days, either party may pursue legal action.

15. Class Action Waiver

YOU AGREE TO RESOLVE ANY DISPUTE ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
